Terms and Conditions of Sound Performance

By viewing www.spracingonline.com hereby known as Sound Performance, Inc. or SP or buy purchasing any items from SP, All customers (including dealers) agree to all terms and conditions below.

SP is not responsible for any damage, incidental or direct for any part purchased from SP.

SP reserves the right to change prices listed on our website at any time without notice. Customer will be notified of any price changes before order processing.

Images and pictures are often only an example of the product, and actual product may vary.

Conditions of Sale: All sales of used items are sold as is, there are no returns of any used products for any reason whatsoever. The Buyer is responsible for ordering the correct part and fitment for their specific application.

Returns or Cancels: Returns must be cleared and authorized through an officer of SP Sales within 5 days of receiving the product. All returned products to SP are subject to 25% restocking fee. Buyer must pay for all Shipping / Handling fees on any and all returns to SP. All products returned for credit must be in the original manufacturer container and never used. The original Buyer is the only person that may request a return for products. All warranty cards, stickers, CARB information and such must be returned with the product. Defective and mis-shipped items may be exchanged only for the originally ordered item only. If SP does not accept the goods as being defective and/or returnable for any reason, Buyer must accept incurred costs. Wheels and Tires which have been mounted or used are not returnable under any condition unless the wrong item was shipped to above stated Buyer. Credit card refunds can take up to 8 days to process. This is not up to us, this is up to your bank.

Absolutely no returns on any electronic items unless if they are defective. Once a defective electronic item is returned, it is up to the manufacture to replace the item. Defective items will only be replaced, not refunded.

Delivery: All credit card order shipments will only be sent to the billing address that the credit card statement is mailed to. Shipments will not be sent to any other addresses whatsoever. This is for YOUR protection and safety. For cases where shipment must be shipped to locations other than billing address a cashiers check or money order must be sent to SP.

Shipping/Handling: Upon receiving your package, immediately inspect for any transportation damage, shipping problems or incorrect parts. SP requires a waiver of rights to be faxed in order to release this information. Buyer cannot change shipment addresses at any time. All US shipments are delivered UPS Ground and must be signed for upon delivery unless otherwise requested or paid for by customer.

Custom and Special Orders: Custom to make orders require a nonrefundable deposit of 50% of total costs for returns and a 10% restocking fee. If there is any cancellation for any reason by the Buyer, that deposit is forfeited immediately to SP. SP is not responsible for any and all late shipments caused by the carrier or freight companies. All shipping dates given are approximate. Buyer is not entitled to chargebacks, reductions of price, or other offsets as result of late shipment or failure to deliver in estimated time of delivery. Special Orders if cancelled for any reason are automatically subjected to a 35 % restocking fee.

Outside Influences: SP is not liable for any failures to deliver product to Buyer for ANY reason or purpose that does not normally occur in the ordinary course of SP Online business.

Performance Products: SP does sell aftermarket items that do not conform to certain smog and legal laws. The Buyer by agreeing to the SP Sales Terms and Conditions understands the ramifications for having these performance or after-market parts on a vehicle. SP is not held responsible for damage, legal problems or otherwise associated with above stated parts.

Warranties: SP sole warranty for any and all products sold is set forth in the warranty documentation associated with the product. SP gives no warranties, express or implied, including, but not limited to, the implied warranties of the product usage for any particular purpose. SP is not liable for any damages, accidents, problems caused by improper installation or usage of products. All products must be installed by experienced, or otherwise certified mechanics with proper knowledge and prior experience.

Installations: Buyer by agreeing to these Terms and Conditions will indemnify and hold SP not liable for any damages incurred as a result of any items purchased from SP. SP is not responsible for any damage to the automobile in any way from any product purchased from SP.

SP is not liable or responsible for any and all parts sold through SP. SP will not be held liable for any parts and does not claim to hold any bearing on legal parts in any state. Please be responsible and obey any and all smog / state regulations regarding these products.

SP is not liable for any additional installation fees or any modifications needed for parts to fit.

Privacy Policy of Sound Performance

We will never give or sell your name, address, phone number, e-mail address, purchasing history or any other information to any other company without your explicit permission. We may send you catalogs or offers if you have ordered a product or catalog from us before, but if you ask us to remove your name from our mailing list, we will do it promptly. We'll send you confirmation e-mail messages (like "Your order has shipped, and here's the tracking number") to the e-mail address you supply to us when you order. We might decide in the future to send you e-mail offers that we think you might like. (We don't do this right now, but we've been thinking about it.) If you ask us not to send you these, we'll remove your e-mail address from the list. We may use your phone number to contact you if there's a problem with your order. We will never use it to try to sell you anything.

Condition of Sale: All sales are final and all products sold by SP (The Seller) are sold "as is" to the Buyer.

We reserve the right to refuse service to anyone.
